Was one of your study sets on Quizlet removed from public access by a Quizlet admin? If so, we are very sorry for any inconvenience that removal has caused and is causing you, your students, and/or your classmates.
However, the Digital Millennium Copyright Act (“DMCA”) requires Quizlet to remove access to study sets that are reported as copyright infringing by a copyright holder or publisher.
If your study content on Quizlet has been removed for this reason, but you feel that this removal is the result of a mistake or misidentification, or believe that you have the rights to share this material due to a license or fair use, you have a couple of options.
First, you might consider submitting a counter notice via Quizlet. Once we receive your counter notice, we will forward it to the copyright holder who requested your content be removed. The copyright holder then has 14 days to file an action seeking a court order to keep the content removed. If they do not take this action, Quizlet will restore this content to public access at the end of this time period.
Please note that filing a counter notice is a serious matter that may have legal and financial consequences if the content is indeed infringing. Consider seeking advice from an attorney if you are not sure whether or not you have rights to share this material.
Second, you might also consider reaching out to the publisher who requested its removal directly, to seek clarification on why it was removed or just to explain how you are using Quizlet to learn or teach.
While we cannot give legal advice on copyright issues, you can contact us here with further questions: email@example.com.
How to submit a counter notice
A counter notice must be a written communication that includes the following:
- (A) Your physical or electronic signature.
- (B) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. (Note: For this section, please include the URL link/s to the sets on Quizlet.)
- (C) A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- (D) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
